Types of Lasting Power of Attorney

What is a Lasting Power of Attorney (LPA) and why is it important?

A Lasting Power of Attorney (LPA) is a legal document that allows you to appoint trusted individuals — known as your attorneys — to make decisions on your behalf if you become unable to do so due to illness or loss of capacity.
Without an LPA, your loved ones may need to apply to the Court of Protection, which can be a lengthy and expensive process, before they are able to manage your affairs.

There are two main types of LPA:

  • Property & Financial Affairs LPA – covers decisions about your money, property, and financial matters.

  • Health & Welfare LPA – relates to choices regarding your medical treatment, care, and day-to-day wellbeing.

Having both types in place provides complete protection and ensures your wishes are respected in all aspects of your life.

Once your LPA has been signed, it must be registered with the Office of the Public Guardian (OPG) before it becomes legally effective. The registration process usually takes between 8 and 12 weeks, although it can take longer during busy periods.

Until registration is complete, your attorneys do not have legal authority to act on your behalf. After registration:

  • A Property & Financial Affairs LPA can be used immediately (if you’ve chosen for it to do so) or only if you lose capacity.

  • A Health & Welfare LPA can only be used once you no longer have mental capacity to make specific decisions yourself.

Your LPA remains legally valid until your death.

A Property & Financial Affairs LPA becomes effective once it has been registered with the OPG, and you may choose to allow your attorneys to act even while you still have capacity — with your consent.
A Health & Welfare LPA, however, only takes effect when you are no longer able to make decisions for yourself.

You can also include clear instructions or restrictions within your LPA to specify how and when your attorneys may act.
